What is quiet
enjoyment?
The landlord usually has very few covenants, however
one such covenant is to allow the tenant/s quiet enjoyment. This
means that the tenant has the right to live in the property without
interference or disruption from the landlord or anybody else. Even
if this was not specifically included in the tenancy agreement it
would be considered an implied right.
Leases contain covenants which are promises by one
party to another, they contain many different covenants. Most covenants
made by the tenant to the landlord. Some covenants may be restrictive
i.e. they allow the person with the benefit of the restrictive covenant
to stop the owner of other land from using that land in some way,
for the benefit of the owner of the covenant. In leases some covenants
state you cannot use the premises for any other purpose that residential
purposes.
